A Federal High Court in Abuja has ordered Mamuda Beverages Nigeria Limited to stop producing its Pop Power Energy Drink in its current bottle design over alleged trademark infringement involving Rite Foods Limited’s Fearless Energy Drink.
Justice B.F.M. Nyako gave the order on Friday while ruling in Suit No. FHC/ABJ/CS/705/2025, according to a statement issued by Rite Foods and signed by its Media Executive, Adejoke Salami.
The court dismissed Mamuda’s preliminary objection challenging the suit and granted Rite Foods’ application for an interlocutory injunction restraining the company from further production of the product pending the determination of the substantive suit.
According to the statement, the judge held that the complaint before the court was different from an earlier case between both parties and observed that Mamuda’s redesigned Pop Power bottle still appeared similar to Rite Foods’ Fearless Energy Drink.
The court consequently ordered Mamuda to halt production of the product and destroy existing stock.
It also directed the court bailiff, alongside representatives of both parties, to compile an inventory of products slated for destruction.

The injunction, the statement added, will remain in force pending the determination of the substantive suit or until the end of the year.
The case was adjourned till September 23, 2026.
Rite Foods recalled that it had earlier sued Mamuda in January 2025 over the alleged imitation of the design and identity of Fearless Energy Drink.
The company said the earlier case ended in a settlement in which Mamuda agreed to stop producing the disputed design, destroy infringing products and avoid further imitation.
However, Rite Foods alleged that Mamuda later reintroduced Pop Power into the market with only slight modifications to its appearance.
The company maintained that the changes failed to address concerns over consumer confusion and brand identity.
